One of the more promising things I've seen post 9/11 is that the Government doesn't seem to have used any of the more Draconian provisions of the PATRIOT act (a most unfortunate piece of legislation, IMHO). The law enforcement types, of course, are well aware that it's not enough to arrest the Bad Guys. You also have to get a conviction, and the conviction has to stand up under appeal.
