In fact, that used to be the case: the first Unions were hauled into court
when they went on strike and convicted as "conspiracy in restraint of
trade".  The right to strike had to be gained politically.  And there are
some techniques that are still formally illegal, which is one reason some
Unions do "working to rule" or "job actions" instead of "strikes".
